THE INS AND OUTS OF MEDIATION - In today's Episode, Bryan & Sam discuss several topics related to mediation, including the mediation services we provide, the benefits of choosing mediation over trial, including the possibility of more creative solutions, mediation's tendency to mitigates animosity between parties, and it's ability to narrow the issues you have to take before a judge. Additionally, they discuss pro se mediations, what they are, the role of the mediator in a pro se mediation, the work the parties need to put in to have a successful mediation, learning to set appropriate expectations, and the importance of having a solid understanding of the issues on the table. Finally, they explore the cost benefit of mediation versus a contested trial, the nature of mediated settlement agreements and what it means for them to be binding, guidance for preparing for mediation, and the pitfalls that cause mediations to break down.

Samuel M. Sanchez is a Board Certified family law attorney and certified mediator who is licensed to practice in Texas and Florida. He was appointed by former Gov. Perry to the Board of Regents for Midwestern University. He has worked in Civil, Criminal, Estate Planning, and Juvenile Law and has an extensive background in high profile, press intensive litigation.
